Agreement and Eligibility

These Terms of Service govern your access to the Build Influencer website, studio, generation tools, subscriptions, credit packages, and related services. By creating an account, purchasing a product, or using the service, you agree to these Terms and our Privacy Policy. If you use the service for an organization, you represent that you have authority to accept these Terms for that organization.

You must be legally able to enter a binding agreement and meet any minimum age required in your location. The service is not intended for use where it would violate applicable law.

Accounts and Security

You are responsible for accurate account information, activity performed through your account, and protecting your login credentials and connected authentication provider. You may not share access in a way that bypasses plan limits, impersonate another person, create accounts for abuse, or transfer an account without our approval. Notify support promptly if you suspect unauthorized use.

Subscriptions, Credits, and Billing

Prices, included credits, billing intervals, renewal terms, and package expiration periods are displayed at checkout or on the pricing page. Subscription charges recur until canceled. When you cancel, access generally continues through the paid billing period unless the checkout terms state otherwise. Plan changes, taxes, currency conversion, and prorated amounts may be handled by the selected payment provider.

Credits are a limited license to use eligible generation features; they are not money, cannot be transferred, and have no cash value. Subscription credits and one-time packages may have different expiration rules. A generation request may reserve or deduct credits based on the selected model and settings. When a provider task is confirmed as failed, the service may release or refund the related credit reservation according to the generation state recorded by the platform.

Except where applicable law or checkout terms require otherwise, completed charges are not automatically refundable. Contact support if you believe a duplicate, unauthorized, or technically incorrect charge occurred. We may request transaction details needed to investigate.

Uploads and User Content

You retain the rights you hold in prompts, images, videos, profile details, and other content you submit. You grant us and our service providers a limited license to host, copy, process, transmit, display, and modify that content only as needed to provide, secure, troubleshoot, and improve the service.

You confirm that you have the rights, consent, and permissions needed for anything you upload. Do not submit confidential information, copyrighted material you are not authorized to use, or a real person's likeness for deceptive, exploitative, or unlawful purposes.

Generated Content and Commercial Use

AI outputs may be inaccurate, unexpected, similar to other outputs, or unsuitable for a particular purpose. We do not guarantee that an output is unique, legally protectable, free of third-party rights, or accepted by a social platform, advertiser, marketplace, or regulator. You are responsible for reviewing outputs before publication and for complying with model-provider terms, intellectual property rules, privacy and publicity rights, advertising standards, and AI disclosure requirements.

Commercial use may depend on your source material, selected model, provider terms, plan, and local law. The service does not provide legal clearance for trademarks, people, products, music, locations, or claims shown in generated content.

Prohibited Activities

• Breaking the law, violating third-party rights, or using the service for fraud, harassment, exploitation, or deceptive impersonation.
• Creating or distributing sexual exploitation content, non-consensual intimate imagery, or content that sexualizes minors or persons who appear to be minors.
• Uploading malware, probing security, interfering with infrastructure, evading rate or credit limits, reverse engineering restricted systems, or automating abusive traffic.
• Misrepresenting generated media as authentic evidence, using a real person's likeness without required permission, or concealing AI involvement where disclosure is required.
• Reselling account access, credits, or service capacity without written authorization.

Service Availability and Third Parties

Generation times and output availability depend on third-party AI providers, storage, networks, and payment systems. Features, models, credit costs, limits, and providers may change as the service evolves. We may pause a feature for maintenance, safety, legal, capacity, or provider reasons.

Links and integrations may lead to third-party services governed by separate terms. We are not responsible for third-party content, policies, availability, or decisions.

Suspension and Termination

We may restrict, suspend, or terminate access when reasonably necessary to protect the service or users, respond to legal requirements, address payment failure, or investigate a material violation of these Terms. You may stop using the service at any time and may request account deletion, subject to records we must retain for legitimate legal, financial, fraud-prevention, or dispute purposes.

Disclaimers and Limitation of Liability

The service is provided on an as-is and as-available basis to the extent permitted by law. We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. Nothing in these Terms excludes warranties or liabilities that cannot legally be excluded.

To the maximum extent permitted by law, Build Influencer and its providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, business opportunities, or content. Any aggregate liability will be limited to the amount you paid for the service during the twelve months before the event giving rise to the claim, unless applicable law requires a different result.

Changes and Contact

We may update these Terms as the product, pricing, providers, or legal requirements change. The revised Terms will be posted here with a new effective date.
